Monday marks an important day in the ongoing investigation into former President Donald Trump, as an attorney for Trump may be called before a Manhattan grand jury to discredit key witness Michael Cohen.

Two sources who are familiar with the matter confirmed to CBS News that Cohen, Trump’s former personal attorney, has been asked to be available if needed before the grand jury which is investigating an alleged “hush money” payment Cohen made to adult film star Stormy Daniels ahead of the 2016 election. Cohen has been asked to remain in close proximity to the grand jury, which meets in Lower Manhattan, in case he is needed to “rebut” another witness expected to testify Monday.

The sources also revealed that attorney Robert Costello, who served Cohen as a legal adviser prior to their falling out, may appear before the grand jury to discredit Cohen. Costello has been asked by Trump’s attorneys to make an appearance, however, it is unclear if he will actually be called as The New York Times was the first to report about Costello’s potential appearance.

On Saturday, Trump posted on social media that he anticipates to be arrested by Manhattan District Attorney Alvin Bragg on Tuesday. Trump did not post any details that could clue into what he could be charged with. Bragg’s office has been conducting an investigation into the $130,000 Cohen paid Daniels ahead of the 2016 election. The president also addressed his followers in the post, calling for them to “PROTEST, TAKE OUR NATION BACK!” in the event of his arrest.

Trump also accused Bragg on his Truth Social platform of “breaking the law by using the fake and fully discredited testimony … of a convicted liar, felon, and jailbird, Michael Cohen.” Earlier this month, Trump was invited to testify before the grand jury, an invitation which was rejected by the former president’s attorney, Joe Tacopina.

Trump’s attorney Susan Necheles sms-ed CBS News saying that since the investigation is political, the District Attorney’s office is engaging in the practice of “leaking everything to the press, rather than communicating with President Trump’s attorneys as would be done in a normal case.” However, Bragg has not commented on Trump’s social media posts.

In response to the potential threats, Bragg sent a memo to staff on Saturday assuring them that their safety is a top priority. He also said that they are in touch with their law enforcement partners to make sure that any specific or credible threats against the office will be fully investigated and that the proper safeguards are in place.

In conclusion, Trump’s attorneys may call upon Robert Costello to discredit Michael Cohen before the grand jury on Monday. Cohen served as a key witness in the investigation into Trump and reported to prison in May 2019 on federal charges related to the alleged payout as well as charges of tax evasion and lying to Congress. Trump has denied any wrongdoing. Regardless of the outcome, Bragg sent a memo to staff to ensure their safety and stay in touch with law enforcement partners.
