International Criminal Court Moves to Arrest Israeli and Hamas Leaders
The International Criminal Court’s chief prosecutor, Karim A.A. Khan, announced on Monday that he was filing applications for arrest warrants at the ICC for Israeli Prime Minister Benjamin Netanyahu, Israeli Minister of Defense Yoav Gallant, and three senior Hamas leaders. These Hamas leaders include the group’s overall political leader Ismail Haniyeh, its military commander in the Gaza Strip Yahya Sinwar, and the overall leader of the group’s military wing, Mohammed Diab Ibrahim Al-Masri. The warrants stem from an investigation into Hamas’ terrorist attack on Israel and Israel’s military response in Gaza.
Israel and Hamas Respond to ICC Prosecutor’s Request
Both Israeli officials and Hamas criticized the ICC chief prosecutor’s actions. Israeli Prime Minister Netanyahu described the move as a “moral outrage of historic proportions,” while Israeli Minister of Defense Gallant called the comparison between Hamas and Israel despicable. President Biden also condemned the ICC’s decision, stating that there is no equivalence between Israel and Hamas.
Crimes Alleged Against Netanyahu, Gallant, Sinwar, Haniyeh, and Al-Masri
The ICC accuses Netanyahu and Gallant of war crimes and crimes against humanity, including starvation of civilians, causing great suffering, willful killing, attacks against a civilian population, murder, persecution, and other inhumane acts. On the other hand, Sinwar, Haniyeh, and Al-Masri face allegations of war crimes and crimes against humanity such as extermination, murder, taking hostages, rape, torture, cruel treatment, and outrages upon personal dignity.

The International Criminal Court, established in 2002 by the Rome Statute, prosecutes individuals for serious crimes under categories including genocide, crimes against humanity, war crimes, and the crime of aggression. Violations of international legal standards for warfare, as outlined in treaties like the Geneva Convention and the Geneva Protocol, can lead to imprisonment for perpetrators.
