A recent ruling by a federal appeals court has determined that former President Donald Trump is not currently shielded by absolute immunity from civil lawsuits related to the violence that occurred at the US Capitol on January 6, 2021.

Trump’s Argument Rejected by DC Circuit Court

The US Court of Appeals for the DC Circuit has officially rejected Trump’s defense, which asserted that his presidential status at the time protected him from legal action regarding his actions leading up to the attack and his statements made during a rally on that same day.

Opportunity to Claim Immunity Still Open

While the court ruling denies Trump’s claim of immunity at this stage, it does leave the door open for him to potentially assert that defense again later in the case.
