New Mexico Judge Removes Couy Griffin from Office

In a groundbreaking decision, New Mexico Judge Francis J. Mathew has removed Couy Griffin from his position as Otero County Commissioner for his involvement in the January 6 attack on the U.S. Capitol. Judge Mathew cited Section 3 of the Constitution’s 14th Amendment in his ruling, stating that Griffin engaged in an “insurrection” against the Constitution after taking his oath of office.

Historic Ruling Against Insurrection

According to Citizens for Responsibility and Ethics in Washington (CREW), Griffin has become the first person in over a century to be ousted from office on grounds of insurrection. The organization assisted in representing New Mexico residents who brought forth the suit against Griffin following his participation in the riot.

Legal Justification for Removal

Judge Mathew emphasized that Griffin’s actions contributed to the delay of Congress’s election-certification proceedings by trespassing on restricted Capitol grounds. He made it clear that a criminal conviction is not necessary for disqualification from holding public office.

Griffin’s Participation in Capitol Riot

Griffin, who was previously charged with a misdemeanor for breaching the Capitol grounds, was seen on January 6th manning a bullhorn and inciting the crowd to join him in what he described as a “war.” Despite not entering the Capitol building himself, his involvement in the events of that day led to his removal from office.

Impact on Republican Lawmakers

This ruling sets a precedent for accountability for lawmakers who supported former President Trump’s efforts to undermine the 2020 election results. While some Republican nominees for the 2022 midterms continue to deny the legitimacy of the election, the ruling may not deter those currently in office who voted against certifying Joe Biden as president.
