Illinois Man Faces Charges for U.S. Capitol Breach
An individual from Summit, Illinois, has been accused of breaking through a police line and firing a weapon into the air during the January 6th attack on the U.S. Capitol in Washington, D.C. Federal authorities have charged John Banuelos, 39, with various offenses, including civil disorder and discharging a weapon on Capitol grounds.
Felony Charges and Maximum Sentence
If convicted, Banuelos could face a maximum of 10 years in prison for the most severe charges outlined in the federal criminal complaint. He is among nearly 50 individuals from Illinois who have been implicated in the Capitol breach.
Court Appearance and Detention Hearing
Following his arrest, Banuelos appeared at the Dirksen U.S. Courthouse in Chicago. Despite attempts by prosecutors to have him detained pending trial due to being a danger to the community, a detention hearing has been scheduled for Wednesday by U.S. Magistrate Judge Beth Jantz.
Incidents and Allegations
The complaint against Banuelos details his actions during the rally held by former President Donald Trump on January 6, 2021. Video evidence depicts Banuelos pointing at police officers, kicking barricades, and eventually breaching the police line with a group of rioters.
Further footage shows Banuelos climbing scaffolding on the Inaugural stage, waving to the crowd, and discharging a firearm into the air. A witness recognized Banuelos from a distributed FBI photograph, linking him to the events of that day.
Additional Allegations and Previous Incident
Banuelos was also identified by NBC News in connection with a fatal stabbing incident in Salt Lake City in July 2021. He reportedly informed Salt Lake City police that he was aware of potential FBI interest in him due to his involvement in the Capitol riots.
Nationwide Ramifications
The Capitol breach investigation, deemed the largest criminal probe in the country’s history by prosecutors, has led to the arrest of over 1,300 individuals across all states and the District of Columbia. In Illinois alone, a diverse range of individuals, including a Chicago police officer and a retired firefighter, have faced charges related to the breach.
